01 Acceptance of Terms

02 Services Offered

Obsidian Luxe Holdings LLC arranges real-estate financing by matching real-estate investors with third-party lenders. We are not the lender: loans are made by third-party lending partners, subject to their underwriting, approval, and applicable state licensing. Through this Site, we provide general informational content about the loan programs we help place and the contact channels through which qualified parties may inquire about financing.

The loan programs we help arrange include, but are not limited to:

• DSCR (Debt Service Coverage Ratio) loans
• Bridge loans and short-term financing
• Hard money and asset-based lending
• Construction and ground-up development loans
• Multifamily and commercial real estate loans
• Purchase-and-rehab and fix-and-flip financing
• Rate/term and cash-out refinancing

All loan terms, rates, and availability are illustrative ranges only; they vary by product, property, borrower profile, and state, and are subject to change without notice — a principal confirms exact terms for your file. Any loan-to-value (LTV), loan-to-cost (LTC), or after-repair-value (ARV) figures shown are maximums ("up to") and are subject to underwriting and lender approval; they are not offered or guaranteed. Availability varies by state and is subject to applicable state licensing. Publication of program details on this Site does not constitute a binding commitment to lend.

The financing we help arrange is intended for business, commercial, and investment purposes only, secured by non-owner-occupied real estate; it is not offered for personal, family, or household (consumer) purposes. Because these are business-purpose loans, certain consumer-lending disclosures may not apply. We do not make credit decisions and are not the lender.

03 Eligibility

This Site and the services described herein are intended solely for:

• Individuals who are at least 18 years of age;
• Legal entities lawfully operating under the laws of their jurisdiction of formation; and

You are never required to consent to receive SMS messages as a condition of submitting a form, obtaining a loan, engaging our services, or doing business with Obsidian Luxe Holdings LLC. Consent is entirely voluntary.

TCPA Compliance

No Sharing of Your Phone Number

12 Governing Law & Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of this Site shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, conducted in Wyoming. Each party shall bear its own attorneys’ fees and costs unless the arbitrator determines otherwise.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis, and not in a class, consolidated, or representative action.
